1. Agreement to Terms

By accessing or using LawnHero's lawn care management software and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and LawnHero Pty Ltd (ABN pending), a company registered in Queensland, Australia.

2. Description of Service

LawnHero provides a cloud-based and offline-capable software platform for managing lawn care and garden maintenance businesses. Features include customer management, job scheduling, route optimisation, invoicing, and business analytics.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use LawnHero. By using the Service, you represent that you meet these requirements.

4. Account Registration

To use LawnHero, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorised access

5. Subscription and Payment

5.1 Pricing

LawnHero offers subscription plans as described on our pricing page. All prices are in Australian Dollars (AUD) and include GST where applicable.

5.2 Free Trial

New users receive a 1-month free trial. No credit card is required to start a trial. At the end of the trial, you may subscribe to continue using the Service.

5.3 Billing

Subscriptions are billed monthly or annually in advance. Payment is processed through our secure payment provider, Stripe. You authorise us to charge your payment method on each billing date.

5.4 Refunds

We offer a 30-day money-back guarantee on annual plans. Monthly subscriptions are non-refundable but you may cancel at any time to stop future charges.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the Service
  • Use the Service to send spam or unsolicited messages
  • Resell or redistribute the Service without permission

7. Your Data

7.1 Ownership

You retain ownership of all data you enter into LawnHero ("Your Data"). You grant us a limited licence to use Your Data solely to provide the Service.

7.2 Data Export

You may export Your Data at any time through the settings menu. We will provide Your Data in a common format upon request.

7.3 Data Security

We implement industry-standard security measures to protect Your Data. See our Privacy Policy for details.

8. Intellectual Property

LawnHero and its licensors own all rights, title, and interest in the Service, including all software, design, logos, and documentation. You receive only a limited licence to use the Service as described in these Terms.

9. Third-Party Services

LawnHero may integrate with third-party services (e.g., Google Maps, Stripe). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance and will provide notice when possible. The offline features of LawnHero allow continued use during internet outages.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

12. Indemnification

You agree to indemnify and hold harmless LawnHero and its officers, directors, and employees from any claims arising from your use of the Service or violation of these Terms.

13. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your access if you violate these Terms or fail to pay. Upon termination, your right to use the Service ends, but we will retain Your Data for 30 days to allow export.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
